4.000 Introduction
The following definitions explain the types of evidence of ownership documents that the department accepts from a dismantler to place “junk” status on a vehicle record. For those not discussed, contact your local DMV for assistance.
3.050 Voiding a Notice of Acquisition/Report of Vehicle To Be Dismantled (REG 42)
To void a Dismantlers Notice of Acquisition/Report of Vehicle To Be Dismantled because of an error, write “VOID” across all copies of the set. Keep the triplicate copy for your records and mail the original and duplicate copies to:

If the Dismantlers Notice of Acquisition was mailed to the department before the error was discovered:
- Complete a Statement of Facts (REG 256) (PDF) explaining the reason for voiding the Dismantlers Notice of Acquisition.
- Void the corresponding Report of Vehicle To Be Dismantled and attach it to the Statement of Facts (REG 256) (PDF).
- Mail both of these immediately to the above address.

3.030 Sample – Notice of Acquisition/Report of Vehicle To Be Dismantled

3.020 Report of Vehicle To Be Dismantled (REG 42)
The Report of Vehicle To Be Dismantled (upper portion of the REG 42) — The original and duplicate copy must be submitted within 90 days of acquisition of the vehicle with the required clearance documents to record a vehicle as dismantled. The duplicate copy is validated by the department and returned to the dismantler. The triplicate copy is retained by the dismantler as a permanent business record.
3.010 Dismantlers Notice of Acquisition (REG 42)
The Dismantlers Notice of Acquisition (lower portion of the REG 42) is used to report vehicles acquired for dismantling to the department and the Department of Justice.
Within five calendar days (this includes Saturdays, Sundays and state holidays) not including the day of acquisition, the dismantler must mail the original and duplicate copies of the completed Notice of Acquisition as shown below. The postmark date on the envelope will be used to determine compliance. The triplicate copy is retained by the dismantler as a permanent business record.

3.000 Reporting Documents
The Dismantlers Notice of Acquisition/Report of Vehicle To Be Dismantled (REG 42) is a two part form supplied to licensed dismantlers by the department.
2.060 Delivering Documents to a DMV Office
Documents pertaining to dismantled vehicles may be delivered to DMV by listing the applications on a Transmittal of Registration Applications (FO 247).
Submit the original and two copies of the FO 247, with the completed applications attached, to a DMV office within 90 calendar days from the date you acquire the vehicle. Refer to Appendix 1D for the 90-day chart to determine the last day an application may be submitted to DMV without penalty.
2.050 Documents Required To Obtain Authority To Dismantle a Vehicle
Mail or deliver the following documents to the department within 90 calendar days from the date of acquisition:
- Original and duplicate copies of the Report of Vehicle To Be Dismantled (REG 42). The control number on this form must match the previously submitted Dismantlers Notice of Acquisition (REG 42) control number.
- Evidence of ownership. See Chapters 4 and 5 for acceptable ownership documents.
- Last-issued license plates and sticker or Dismantler’s Notice of License Plate Destruction (located on the bottom portion of the Report of Vehicle To Be Dismantled [REG 42]).
- A Board of Equalization Certificate of Excise Tax Clearance (BOE 1138) is required for a commercial vehicle with an unladen weight of more than 7,000 pounds and powered by fuel other than gasoline or diesel (RTC §§8608, 8995).
The Certificate of Excise Tax Clearance (BOE 1138) is only available from the State Board of Equalization headquarters office in Sacramento and may be obtained by contacting them as follows:

Dismantlers are exempt from odometer disclosure reporting but they should submit any disclosure statements received when they acquired the vehicle.
Fees—A licensed dismantler is not required to pay fees or penalties on a vehicle that is to be dismantled.
2.040 When a Vehicle Can Be Dismantled (VC §11520)
A vehicle can be dismantled:
- Ten days after the Dismantlers Notice of Acquisition (REG 42) is mailed to the department.
- Any time after the Report of Vehicle To Be Dismantled (REG 42), evidence of ownership, and license plates or Dismantler’s Notice of License Plate Destruction are delivered to the department.
- Immediately, by a licensed dismantler, without regard to the 10-day waiting period, if the vehicle:

- was acquired from a city or county under a local abatement program (VC §§ 22660 & 22664).
- already has “junk” status on the DMV record.
