{"id":13687,"date":"2020-04-15T15:24:08","date_gmt":"2020-04-15T22:24:08","guid":{"rendered":"https:\/\/www.dmv.ca.gov\/portal\/handbook\/vehicle-industry-registration-procedures-manual-2\/miscellaneous-originals\/new-vehicle-sales-by-a-non-franchised-dealer\/"},"modified":"2026-03-04T08:26:07","modified_gmt":"2026-03-04T16:26:07","slug":"new-vehicle-sales-by-a-non-franchised-dealer","status":"publish","type":"dmv_handbook","link":"https:\/\/www.dmv.ca.gov\/portal\/es\/handbook\/vehicle-industry-registration-procedures-manual-2\/miscellaneous-originals\/new-vehicle-sales-by-a-non-franchised-dealer\/","title":{"rendered":"7.070 New Vehicle Sales by a Non-Franchised Dealer"},"content":{"rendered":"<p>A dealer <strong>cannot<\/strong> advertise for sale, sell, or purchase for resale any <strong>new<\/strong> vehicle of a line-make for which the dealer does<strong> not<\/strong> hold a franchise (VC \u00a711713.1(f)(1)).<\/p>\n\n\n\n<p><strong>Exceptions (VC \u00a711713.1(f)(2))<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A mobile home.<\/li>\n\n\n\n<li>A recreational vehicle (motorhome, travel trailer, or camping trailer) as defined in <em>Health and Safety Code<\/em> (H&amp;SC) \u00a718010.<\/li>\n\n\n\n<li>A commercial coach as defined in H&amp;SC \u00a718001.8.<\/li>\n\n\n\n<li>An off-highway motor vehicle (OHV) subject to OHV identification. <strong>See Chapter 15.120\u00a0<\/strong><a href=\"\/portal\/es\/handbook\/vehicle-industry-registration-procedures-manual-2\/off-highway-vehicles\/registration-of-noncomplying-ohv\/\"><strong>Registration of Noncomplying OHV (VC \u00a7\u00a74000, 38010, 38012, and 38040)<\/strong><\/a>.<strong>\u00a0<\/strong><\/li>\n\n\n\n<li>A commercial vehicle with a gross vehicle weight (GVW) rating of more than 10,000 pounds.<\/li>\n\n\n\n<li>A manufactured home.<\/li>\n\n\n\n<li>A new vehicle that will be substantially altered or modified by a converter prior to sale.<\/li>\n\n\n\n<li>A vehicle purchased for export and exported outside the United States territorial limits <strong>without being registered<\/strong> by DMV.<\/li>\n<\/ul>\n\n\n\n<p><span role=\"region\" class=\"format-label--important\"><span class=\"format-label__text\">Important<\/span> Some of the exceptions listed above are vehicles that are not registered by DMV or cannot be registered as a condition of the exception.<\/span><\/p>\n\n\n\n<p><strong>Registration Requirements<\/strong><\/p>\n\n\n\n<p>When one of the exception vehicles is sold by a non-franchised dealer or a used vehicle dealer, the following are required:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Properly completed <a rel=\"noreferrer noopener\" href=\"https:\/\/www.dmv.ca.gov\/portal\/es\/file\/application-for-title-or-registration-reg-343-pdf\/\" target=\"_blank\">Application for Title or Registration (REG 343) (PDF)<\/a>.<\/li>\n\n\n\n<li>Report of Sale, Used Vehicle (REG 51) from the dealer to the retail buyer.<\/li>\n\n\n\n<li>Evidence of purchase of the new vehicle by the dealer. This may be either:\n<ul class=\"wp-block-list\">\n<li>An Application for Registration of New Vehicle (REG 397) from the franchised dealer, <strong>or<\/strong> <\/li>\n\n\n\n<li>A certified copy of the factory invoice and a bill of sale from the manufacturer, <strong>or<\/strong> <\/li>\n\n\n\n<li>The Manufacturer&#8217;s Certificate\/Statement of Origin (MCO\/MSO) properly endorsed to the dealer. <em>Bills of Sale<\/em> are acceptable in lieu of endorsement(s) on the MCO\/MSO. <\/li>\n<\/ul>\n<\/li>\n\n\n\n<li> Vehicle verification (<a rel=\"noreferrer noopener\" href=\"https:\/\/www.dmv.ca.gov\/portal\/es\/file\/application-for-title-or-registration-reg-343-pdf\/\" target=\"_blank\">REG 343 (PDF)<\/a>\/<a rel=\"noreferrer noopener\" href=\"https:\/\/www.dmv.ca.gov\/portal\/es\/file\/verification-of-vehicle-reg-31-pdf\/\" target=\"_blank\">REG 31 (PDF)<\/a>), <strong>unless<\/strong> a REG 397 is part of the application.<\/li>\n\n\n\n<li>Weight Certificate for a Commercial Vehicle less than 10,001 pounds unladen or if the vehicle weighs 10,001 pounds or more, or is a trailer in the PTI program, the estimated unladen weight is required and must be shown on a <a rel=\"noreferrer noopener\" href=\"https:\/\/www.dmv.ca.gov\/portal\/es\/file\/statement-of-facts-reg-256-pdf\/\" target=\"_blank\">Statement of Facts (REG 256) (PDF)<\/a>.<\/li>\n\n\n\n<li><a href=\"https:\/\/www.dmv.ca.gov\/portal\/es\/file\/declaration-of-gvw-cgw-reg-4008\/\" target=\"_blank\" rel=\"noreferrer noopener\">Declaration of Gross Vehicle Weight\/Combined Gross Vehicle Weight (REG 4008)<\/a> completed and signed by the owner for a commercial vehicle weighing 6,001 pounds or more unladen.
