Co-owner names may be joined by \u201cand\u201d, \u201cand\/or\u201d, or \u201cor\u201d. All owners <strong>must<\/strong> endorse the title or registration application to register the vehicle\/vessel, but the requirements for releasing ownership vary. Refer to Chapter 11.<\/p>\n\n\n\n<p><span role=\"region\" class=\"format-label--note\"><span class=\"format-label__text\">Note<\/span> Certificates issued for applications <strong>not<\/strong> indicating \u201cand\u201d or \u201cor\u201d between the names will show \u201cand\u201d as represented by a slash (\/) between the names.<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The signatures of <strong>all<\/strong> owners are required to transfer ownership when the co-owner names are joined by \u201cand\u201d. Ownership passes to the surviving co-owner upon the death of a co-owner or, with the surviving co-owner\u2019s release, to a new owner. A deceased co-owner\u2019s interest may only be released by one of the following:\n<ul class=\"wp-block-list\">\n<li>Heir of the deceased with an <a rel=\"noreferrer noopener\" href=\"https:\/\/www.dmv.ca.gov\/portal\/es\/file\/affidavit-for-transfer-without-probate-california-titled-vehicle-or-vessels-only-reg-5-pdf\/\" target=\"_blank\">Affidavit for Transfer Without Probate California Titled Vehicle or Vessels Only (REG 5) (PDF)<\/a> form.<\/li>\n\n\n\n<li>Administrator with Letters of Administration.<\/li>\n\n\n\n<li>Executor with Letters Testamentary. <\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The signature of only <strong>one<\/strong> owner is required to transfer ownership when the co-owner names are joined by \u201cand\/or\u201d or \u201cor\u201d. A surviving co-owner\u2019s signature on the title releases all owners\u2019 interest unless \u201cTenants in Common\u201d or \u201cCOMPRO\u201d follows the co-owner\u2019s names.<\/li>\n\n\n\n<li>A REG 5 cannot be used to circumvent the interest of a surviving owner when the vehicles are jointly owned by two or more persons and one of the owners is deceased. However, the surviving owner (if they are the heir) may complete a REG 5 to release the interest of the deceased owner. The California Certificate of Title must be signed twice, once by surviving owner and once for the deceased owner countersigned by the heir. If owned jointly by two or more deceased owners, a REG 5 for the most recently deceased owner and a death certificate for each owner is required.<\/li>\n<\/ul>\n\n\n\n<p><strong>Tenants in Common<\/strong>\u2014When \u201cTenants in Common\u201d follows the names of co-owners, the interest of a deceased co-owner reverts to the deceased co-owner\u2019s estate, <strong>not<\/strong> to the surviving co-owner.
